TraskBritt Team Wins Three Rare Patent Preliminary Injunctions in 18 Months

A TraskBritt litigation team led by H. Dickson Burton has scored major upsets in the U.S. District Court for the District of Utah, winning three rarely-granted patent preliminary injunctions in an 18-month period. The first injunction came in Won-Door Corporation v. Cornell Iron Works, Inc., 2:13-cv-00331-TS, a case involving infringement of a Utah company’s patented overhead tracks for use on movable partitions (doors). The Court granted the preliminary injunction in October 2013, which removed Cornell’s infringing products from the market. The Court later entered a permanent injunction, ending the case favorably for Won-Door.

TraskBritt won two more preliminary injunctions for a Utah medical device manufacturer in Catheter Connections, Inc. v. Ivera Medical Corporation/3M, 2:14-cv-00070-TC. The first injunction was granted in Spring 2014. The TraskBritt team then filed and won a motion finding Ivera in contempt for violating the first injunction. A second injunction was granted in Spring 2015, again taking the competitor’s infringing products off the market. As preliminary injunctions are rarely granted, particularly in contested patent cases, Mr. Burton’s and TraskBritt’s accomplishments in these hotly contested disputes are truly extraordinary.
